1. Terms

Motorkart Rent a Car L.L.C (collectively “Motorkart”, “we”, “us”, “our”) is based in the UAE and owns and operates the Internet website at www.motorkart.ae (the “Website”) and a mobile Application (the “App”) (The Website and the App are collectively referred to as the “Platform”).

By accessing and using the Platform, you are expressly consenting to terms and conditions outlined on this page that are effective as of the date and time you use or access the Platform (the “Terms”). Please read the Terms carefully before accessing or using the information and services available through this Platform.

These Terms will constitute a legal agreement between “you” (the User of this Platform) and Motorkart. If you do not agree to, or cannot comply with, the Terms kindly refrain from using this Platform.

These Terms may be modified from time to time without notice to you and you should therefore regularly review these Terms for any such modifications. If you do not agree to any change to the Terms then you must immediately stop using the Website.

2. Company Ownership and Role

Motorkart is a UAE-licensed self-drive car rental company. We own and operate our own fleet of vehicles and provide car rental services directly to customers. We do not connect users to third-party car rental providers. All rental bookings are with Motorkart as the primary service provider.

3. Eligibility

• You must be at least 21 years old to rent economy or standard cars, and at least 25 years old to rent luxury or premium vehicles.
• A valid driving license is required. For UAE residents, a UAE driving license is mandatory. For tourists, an international driving permit (IDP) or valid license from recognized countries is accepted.

4. Required Documents

UAE Residents:

• Emirates ID (copy)
• Valid UAE driving license

Tourists:

• Passport copy with entry stamp
• Valid International Driving Permit or home country license (depending on eligibility)

5. Rental Terms

• All rentals are for self-drive use only. No chauffeurs are provided.
• Vehicle usage outside UAE is strictly prohibited unless written permission is provided by Motorkart.
• Minimum rental duration is 1 day (24 hours). Delays beyond the rental end time will incur extra charges.
• Daily, weekly, and monthly rental packages are available.

6. Payment Terms

• Full payment must be made in advance via credit/debit card, bank transfer, or cash.
• A refundable security deposit is required for each rental. The amount depends on the vehicle category and is refunded after 21 working days (bank timelines may vary).

7. Insurance Coverage

• All vehicles come with standard insurance.
• Any damage due to negligence or traffic rule violations is the renter’s responsibility.
• Optional full coverage insurance is available at an extra cost.

8. Mileage Limits

• Rentals include a predefined mileage limit based on the selected package (e.g. 200 KM/day or 4000 KM/month).
• Extra KM will be charged as per the contract rate.
• Unlimited KM packages is not available.

9. Fuel Policy

• The vehicle must be returned with the same fuel level as when rented. Fuel difference will be charged.

10. Maintenance and Breakdown

• Motorkart is responsible for regular maintenance.
• In case of a breakdown, roadside assistance is included.
• Replacement vehicle will be provided subject to availability.

11. Fines, Salik & Violations

• All Salik (toll charges), traffic fines, and RTA violations during the rental period will be charged to the renter.
• A service fee may be added to process fines or violations.

12. Booking, Cancellation & Refund

• Bookings can be made online or via phone.
• Cancellations made at least 24 hours before pickup are eligible for full refund minus AED 50 admin fee.
• No refunds for cancellations made within 24 hours of the rental start time.

13. Vehicle Condition & Returns

• All vehicles are provided in clean, working condition.
• Renters must return vehicles in the same condition. Cleaning charges apply for heavily soiled interiors.
• Damage during the rental period will be assessed and deducted from the deposit.

14. Prohibited Uses

• Off-road driving (unless vehicle is off-road approved)
• Drifting, racing, towing, or commercial transport
• Allowing unauthorized drivers

15. Limitation of Liability

Motorkart will not be liable for any indirect, incidental, or consequential damages resulting from the use of its rental services.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. All disputes shall be resolved in the courts of Dubai, UAE.
